This Privacy Policy applies to all personal information collected by Fulton Industries Australia Pty Ltd (ACN 003 971 417). We are committed to treating the personal information we collect in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth) (the Privacy Act). This Privacy Policy sets out how we handle personal information.

Your privacy is very important to us. For that reason, please read the following details carefully and get in contact with us if you have any questions. 


2. Collection and Purpose - Purchasing Goods and Services  

If you request that we open an account for you, or otherwise order goods or services from us, we may collect the following personal information:

  • name, and if you are a company the names of your authorised representatives; 
  • address details including your principal place of business as well as any delivery address;  
  • email address;  
  • phone numbers; 
  • if we are required to verify identity, copies of identification documents;  
  • payment information, such as credit card numbers;  
  • any other similar information that may be required to open an account for you, or otherwise receive and process your order for goods and services.  

We only collect the personal information necessary to open a trading account for you, and to supply you with the goods and services that you order.

We will use this personal information in the following way:

  • to confirm who we are contracting with; 
  • to carry out credit checks, if we are providing you with payment terms;  
  • to supply you with the goods and services, and to make deliveries to you;  
  • to process payments; 
  • aggregating and analysing customer data to improve our business and product offerings;  
  • for any other purposes reasonably required as part of a normal commercial relationship.  

If you make payments to us through our credit card gateway, we do not have access to, and do not hold, your credit card information. All of your credit card information will be held by our credit card gateway supplier and is subject to their terms and conditions.

We reserve the right to change our credit card gateway provider from time to time, and you acknowledge that the disclosure of the name of the gateway provider on the payment page is sufficient notice to you of this.

All other information that you provide to us is stored in our IT system, which uses Oracle NetSuite and is subject to their terms and conditions and their privacy policy, which can be found at (https://www.netsuite.com/portal/resource/terms-of-service-suitecloud.shtml). Generally, our data is hosted in Australia. However, as we use a third-party provider based in America, the precise location of our data storage is sometimes outside of our control. In the event our data is hosted outside of Australia, you agree you consent to this transfer.


3. Collection and Purpose - Website  

We may also collect personal information from you if you input any personal information into the website. In addition, we also collect cookies from your computer, which enables us to tell when you use the website and to help customise your website experience.

The purpose for which we collect personal information is to provide you with the best service experience possible on the website and for our marketing purposes. Some provision of personal information is optional. If you do not provide us with certain types of personal information, you may not be able to enjoy the full functionality of the website.

4. Disclosure  

We customarily disclose or allow access to personal information only to our service providers who assist us in operating our business.This may include but is not limited to, our IT providers and Oracle support partners. We do not actively disclose your information to these service providers, but they may be able to access certain information whilst providing service to us. We will only disclose personal information to an unrelated third party in the course or furtherance of our operations or as required by law.

We reserve the right to transfer the information that we collect to a purchaser or assignee of our business.

We do not assume any liability for the exchange of information, and we cannot guarantee the security of the personal information that you provide to us.


5. Access and correction
